General Terms and Conditions of Neumühle Hotel- und Gaststättenbetriebs GmbH
01 If a hotel room / function room is ordered, confirmed or provided, a guest accommodation contract / rental contract has been concluded. The contract for a hotel room includes accommodation and breakfast. The contract for function rooms only includes the use of the function room. The agreed fee is the applicable daily rate.
02. the subletting or re-letting of function rooms, exhibition or advertising space requires the prior written consent of Neumühle Hotel- und Gaststättenbetriebs GmbH (hereinafter referred to as the hotel).
03. room reservations are held until 6 p.m. on the day of arrival, after which they go on sale. Exceptions are guaranteed bookings.
04. option bookings are binding for both contracting parties. The hotel reserves the right to reallocate the reserved hotel rooms / function rooms after the option bookings have expired.
05. the agreed prices include the respective statutory value added tax. If the period between the conclusion of the contract and the agreed date of arrival exceeds four months and if the price generally charged by the hotel for the contractual services increases, the contractually agreed price may be increased appropriately, but by no more than 10%.
06. if the customer subsequently wishes to change the number of rooms ordered, other hotel services or the length of stay of the guests, this requires the written consent of the hotel, which can be made dependent on a price adjustment.
07. if and insofar as a right of withdrawal free of charge has been agreed in writing in favor of the customer, for example in the case of optional bookings, the hotel is entitled for its part to withdraw from the contract within the period agreed for exercising the right of withdrawal if the hotel receives inquiries from third parties regarding the rooms booked by the customer and the customer does not waive the right of withdrawal granted to him upon inquiry by the hotel, notifying the hotel of such circumstances.
08. if advance payments requested by the hotel are not made on the date requested, this shall immediately release the hotel from any contractual agreements made.
09. the reserved hotel room is available to the guest from 3 p.m. on the day of arrival until 11 a.m. on the day of departure. A later departure than 11.00 a.m. must be arranged with reception the evening before. For departures after 11.00 a.m., the current daily room rate may be charged.
10. booked function rooms are only available to the contractual partner at the agreed times. Any use beyond this requires prior agreement with the hotel.
11. the contractual partner has no claim to specific hotel rooms / function rooms. Should agreed hotel rooms / function rooms be unavailable in exceptional cases, for whatever reason, the hotel shall endeavor to procure an equivalent replacement.
12. prices quoted: The prices stated on our website, in advertising materials and in other publications are always carefully calculated and determined in good faith. These prices serve as a binding basis for the accommodation contract.
Incorrect price information: Despite our best efforts to be accurate, incorrect prices may be published on our website or in our promotional materials by mistake. Such errors may be caused by technical problems, typing errors or other unforeseeable circumstances.
Correction and withdrawal: In the event of an obvious price error, Neumühle Resort & SPA reserves the right to cancel the affected bookings and withdraw from the accommodation contract. An obvious price error exists if the published price deviates significantly from the actual, standard market price for the corresponding service and is recognizable for an average customer.
Communication in the event of pricing errors: If a booking has been made due to an obvious pricing error, we will contact the guests concerned immediately to explain the error and offer an appropriate solution, such as a rebooking at the correct price or cancellation without cancellation fees.
Goodwill offers: In cases where a cancellation is made due to a price error, the Neumühle Resort & SPA will endeavor to accommodate the guests concerned, for example by offering special discounts or other offers for future stays.
We ask our guests to observe these regulations in connection with price errors and thank you for your understanding and cooperation.
13 The hotel shall make its staff available to the organizer until 01:00. In the event of service beyond this time, as well as catering service, the organizer will be charged the applicable hourly rate per employee and hour commenced.
14. in the event of short-notice rearrangements of room furnishings already ordered involving considerable expenditure, we shall charge the applicable hourly rate per employee and hour commenced.
15. changes to and cancellations of booked function rooms / hotel rooms / package arrangements will be charged:
- up to 15 days before arrival no costs 14 – 8 days before arrival 75 % of the agreed service 7 – 0 days before arrival 80 % of the agreed service
- From 30 overnight stays per event, the deadlines specified under point 14 a) shall be extended by 30 days in each case
- Due to reduced, previously contractually agreed contractual services, the hotel may withdraw special prices, demand new agreements or withdraw from the contract without replacement, as revenue guarantees are not achieved.
- The deadline for free cancellation of a booking of up to 6 rooms depends on the total length of stay originally booked. Cancellation is free of charge if the following deadlines are met:
– by 12:00 noon on the day before arrival for stays of up to 3 nights – by 12:00 noon seven days before arrival for stays of 4 nights or more
– After these deadlines, 80% of the booked services are due.
– Excluded from this are bookings of installments, which cannot be canceled or rebooked due to their discount. - In the event of changes to reservations, we reserve the right to charge a fee of 20% of the originally booked service. If the newly booked services have a higher price, the difference must also be paid.

16. the guest reserves the right to prove that the hotel has incurred no or less damage than the agreed flat rate due to the non-utilization of the service.
17 If the customer is not also the organizer, both are jointly and severally liable.
18. if the hotel has reasonable grounds to believe that the event threatens to jeopardize the smooth operation, safety or reputation of the hotel or its guests, as well as in the event of force majeure, it may cancel the event; the assertion of any claims for damages against the hotel is excluded.
19. newspaper advertisements containing the hotel’s details for invitations to sales events or job interviews, or the use of the name Neumühle Resort & SPA for advertising measures of the contractual partner, require the prior written consent of the hotel. If a publication is made without the hotel’s consent and the hotel’s essential interests are impaired as a result, the hotel has the
right to cancel the event; in this case, payment in accordance with point 14 a) to b) will be insisted upon.
20 In the case of communal meals (menus and buffets), the organizer must inform the hotel of the exact number of participants two working days before the start of the event. This number is considered a guaranteed minimum number and will be charged to the organizer by the hotel in any case. If events at which food is served are canceled by the organizer up to three working days before the start of the event, 75% of the menu/buffet price ordered must be paid by the total agreed number of guests.
21 It is generally not permitted to bring food and drinks into the hotel. Exceptions are only possible in consultation with the hotel and against payment of the usual service charge/corking fee.
22. the installation of presentation material or other objects is not permitted without the hotel’s consent. All decoration material must comply with fire regulations and must not cause any damage.
23. the customer of function rooms for events is obliged to remove all packaging and/or information material brought in by him at his own expense. If the customer fails to comply with this obligation, he shall be obliged to reimburse the hotel for the disposal costs in accordance with the applicable rate.
24 The Contractual Partner shall be fully liable to the Hotel for damage caused by itself, its vicarious agents or its guests to the building and inventory, unless the Contractual Partner can prove that the damage was less severe.
25. insofar as the hotel arranges third-party services of a technical, decorative or other nature for the organizer, it acts on behalf of and for the account of the organizer. The Contractual Partner shall be liable for the careful handling and proper return of these items and shall indemnify the Hotel against all third-party claims.
26. individually paying guests must pay net cash immediately. All guest accounts are payable weekly. Invoices sent on the basis of previous credit agreements are payable without deduction within 10 working days of receipt of the invoice. In the event of late payment, the hotel will charge reminder costs and debt collection costs. In addition, default interest of 5% above the prime rate of the European Central Bank will be charged.
27 The hotel accepts the following credit cards: Mastercard, Diners, Amexco, Visa. Commission claims and special prices are excluded. In individual cases, the hotel is entitled to refuse foreign currency, checks and credit cards.
28 All prices are in euros, including service charge and VAT. An increase in VAT or the introduction of a beverage tax shall be borne by the service recipient irrespective of the time of conclusion of the contract.
29. unused services from package arrangements will not be refunded.
30. faults in technical or other equipment provided shall be rectified immediately as far as possible. However, payments may not be withheld or reduced. Offsetting against counterclaims is excluded unless the counterclaims are undisputed and have been legally established.
31. valuables, money or papers of monetary value (checks, check cards, etc.) must be kept in the room safe. If these are not kept there, the hotel accepts no liability for them.
32. the hotel endeavors to carry out wake-up calls with the utmost care; however, claims for damages due to omission are excluded. Items left behind will only be forwarded on request and freight collect. The hotel undertakes to store items for a period of 6 months. Messages intended for guests as well as mail and merchandise will be handled with care. The hotel will store, deliver and, on request, forward them freight collect. However, liability for loss, delay or damage is excluded.
33. collateral agreements must be made in writing. The invalidity of individual provisions of the contract or the terms and conditions shall not affect the validity of the other provisions. The invalid provision shall be replaced by a valid provision that comes as close as possible to it.
34. place of performance and exclusive place of jurisdiction is Wartmannsroth if the customer is a registered trader, a legal entity under public law or a special fund under public law or if the customer has no general place of jurisdiction in the Federal Republic of Germany
35. security measures and video surveillance
The Neumühle Resort & SPA uses video surveillance technology throughout the outdoor area to ensure the safety of our guests and employees and to protect the property and works of art on the premises. The installation and use of these surveillance cameras is carried out in strict compliance with the applicable data protection laws and in compliance with the right to privacy.
Video surveillance is used exclusively for the purposes of preventing and investigating criminal offenses, the safety of persons on the premises and the protection of property. The recordings are treated confidentially, are only viewed by authorized personnel and are not passed on to third parties unless there is a legal obligation or a court order.
The recordings are stored for a limited period of time, after which the data is securely and irretrievably deleted, unless it must be retained to clarify incidents or for legal reasons.
